Aylesbury Magistrates Court No.3. 26/4/13. Regina v Colin Deryck Jarvis.

I want to openly acknowledge and thank two good and true friends of mine, to whom I am indebted.
 
Aylesbury Magistrates Court No.3. 26/4/13. Regina v Colin Deryck Jarvis.

Jason Jennings - Llanddewi Brefi Ceredigion & Jarratt Jonathan Ivey - Aylesbury Buckinghamshire attended court on my behalf from 09:15 until 15:30. Two true friends. Both of whom are moral, good, decent and honest men.

Neither defence witness was called to give evidence under oath because of the shortcomings and, I would argue, the negligence of the CPS who are the party responsible for bringing me, a totally innocent man, to criminal prosecution at trial.

The CPS's prosecution of me was mucked and rescheduled for 25/6/13 @ Milton Keynes Magistrates Court.

Because of, what can fairly be described as the unprofessional incompetence and lack of due diligence on the part of the CPS and HMCTS listings dept. and through absolutely no fault of ours - the defence team - I am required to impose upon and to inconvenience Jason and Jon for a second time to appear as defence witnesses before Milton Keynes Magistrates Court when the CPS's unconscionable, ill conceived and wholly ill judge prosecution of me recommences in two months time.

Jon, Jason, thank you for standing up next to me and alongside me in my fight to defend myself and uphold my right of: Honest comment, fair comment, free speech and freedom of expression in relation to ALL of the TRUE FACTUAL and ACCURATE content posted within my public social media websites in relation to: BT Group & the Communication Workers Union and the numerous sad, dishonest, deceitful, mendacious, wicked and Godless workplace / trade union place bullies and harassing cowards - identifying applicable BT employees (management operatives & field team operatives) and/or TU officials/members - therein.

Jason, Jon - I owe you both a debt of gratitude.

I believe my social media sites content to be lawful, legal, legitimate accurate and factual information postings. I refute the assertion of any criminal harassment of any other person or entity.
The entirety of my social media content is: Honest comment, fair comment, fair opinion and the exercise of my freedom of expression as described within Article 10 of the ECHR.

It should be noted that my fair opinion and comment, my honest comment, honestly held and honestly expressed in respect of my social media websites are posted without malice toward any individual or entity. 

Rather all my social media content are based upon and supported by true facts, accurate and precise fact which I post with full justification and with full and sufficient clarity in respect of black BT employees and/or CWU members and white BT employees and/or CWU members, all of whom have been instrumental in and fundamentally involved in consistently and constantly pursuing a discriminatory, harassing, victimising, harmful, distressful, alarming and damaging course of conduct toward me within BTs workplace over the period of time stated within all of my social media websites.

I have indicated and identified the subject matter with sufficient clarity throughout the entirety of my social media content and postings. That fact is, I would argue, indisputable and made demonstrably clear within all of my public websites.

I choosing to use the right of every citizen to be offensive towards, to be insulting towards and to heap abusive opprobrium upon numerous black persons and white persons within BT and the CWU is not and cannot be believed to amount to a course of conduct amounting to criminal harassment. 

I believe that expressing offensive, abusive, insulting honest comment, honestly held by me, about the unlawful BT & CWU workplace conduct of persons known to me does not constitute criminal conduct of harassment contrary to the PHA. 
Rather, that in respect of all of my social media content …I believe that in the particular circumstances my pursuit of the course of conduct to be reasonable.  
The fact that another black person(s) or another white person(s) considers my honestly held honest comment to be objectionable and offensive does not / cannot amount to a course of conduct of criminal harassment. 

I am presumed to have the legal right and freedom of any British citizen to express, without malice, honest comment, honestly held about black people and about white people within BT and within the CWU. 
I have exercised that legal right and will continue to so do - within my social media websites. 

As a defendant in criminal prosecution I assert, for the CPS to prosecute me for pursuing a reasonable course of conduct is unconscionable. The CPS’s case against me asserting criminal harassment has no merit, lacks any merit and should, the defendant would argue, be treated as such by a court.

I consider the CPS are attempting to interfere with my right of freedom of expression and restrict my right of freedom of expression and my right to free speech, wholly unjustifiably. My honest comment does not target a particular racial or ethnic group, therefore no interference by the CPS or the court is justified in interfering with and restricting my right to freedom of expression. 

The exact same right possessed by the numerous black persons and white persons I have lawfully, legally, legitimately and justifiably identified and cited by their known bad reputation, by their known bad character and by the unacceptable and reprehensible BT & CWU workplace conduct, maliciously perpetrated against me by those numbers of black persons and white persons who are BT employees and CWU members, within my social media websites.

FACT - Everybody, and I mean everybody, knows the following to be a fact:

The reaction and the response of workplace cowards, whether they be:
(a) stupid workplace racist cowards.
(b)stupid workplace bullying cowards.
(c) stupid workplace cowardly persons who are easily intimidated, frightened off and afraid.
(iv) workplace cowards who are in positions of authority and decision making responsibility.

It is a fact that all of the above will, when confronted, challenged and exposed for what they are, who they are and what they represent, will react / respond by lying.

Respond and/or react with bare faced and obvious lies, deceptions, fabrications, falsehoods, concoctions. In other words the type of cowardly workplace individuals identified will lie lie and lie again, deny deny and deny again, mislead, deceive and manipulate the fact of their cowardly, sick, sad and puke inducing workplace conduct, behaviours and actions.

If the reader does not agree with and acknowledges that as a fact, then you are stupid.

Given the above fact, and given the fact that such workplace cowards, of whatever nature, can rely upon and depend upon the support, the backing, the endorsement and the presented evidence(s) of similar and/or like minded cowardly moronic cretins who are their workplace colleagues / friends / mates / cohorts - it is unsurprising that the above identified (i) to (iv) achieve an outcome  which is both advantageous and beneficial to themselves, including complete exoneration.

THEREFORE....

(a) ALL KINDS OF WHITE PEOPLE PROTECTING WHITE PEOPLE PROTECTING WHITE PEOPLE. COWARDS ONE AND ALL.

(b) ALL KINDS OF BLACK PEOPLE HIDING AND SULKING, AFRAID / FRIGHTENED OF, INTIMIDATED BY AND TOO CHICKEN SHIT SCARED OF WHITE WORKPLACE COWARDS - WHOM THOSE BLACK PEOPLE WITNESS BEING OPENLY CONFRONTED

Question*: Why in the world should the deliberate, purposeful and abhorrent, sad, sick and wholly cowardly individual - and/or gang mentality - workplace/trade union place conduct , actions, behaviours and choices of:
 
(i)  BT/CWU workplace/trade union place bullying liars

(ii) BT/CWU workplace/trade union place bullying cowards

(iii) BT/CWU workplace/trade union place racist cowards

(iv) BT/CWU workplace/trade union place frightened/intimidated/fearful cowards and liars

(v)  and those BT/CWU persons of similar and/or like minds to the aforementioned 

be permitted to remain - anonymous - outside of public knowledge - hidden from public view - unknown - secret - ?

Possible answers are - because of

(i) the shear numbers of the identified BT/CWU workplace perpetrators in question?

(ii) the backing and support the cowardly BT/CWU perpetrators can rely upon?

(iii) the seemingly successful workplace/trade union place outcomes achieved by the BT/CWU cowardly perpetrators in question and their friends?

(iv) the fact that the context is the workplace/trade union place environment of two powerful entities - BT and the CWU?

or

(v)  the passage of time?

However - this blogger's answer to the above Question* is simply this: 

My right to freedom of expression and my demonstrable willingness to be held accountable by the law of the land for openly exercising that freedom. 
Notwithstanding the right of any other person(s) to have recourse to that same law - 25/6/13 MK & 11/7/13 HW - to challenge and oppose the blog author's exercise of that freedom of expression / freedom of speech / honest comment contained within the author's social media websites, pages  and social networks.

The fact of workplace racist bullying perpetrated by workplace racist cowards is a given. 

The fact of workplace bullying perpetrated by workplace bullying cowards is a given. 

The fact of workplace harassment perpetrated by workplace harassing cowards is a given.

The fact of workplace victimisation perpetrated by workplace cowards and those workplace perpetrator's friends/mates/colleagues - et al - is a given.

Irrespective of any and all intended preventative workplace policies and/or action(s) deployed by an employer in it's attempt to comply with employment law. The above facts have always been, are, and will remain - a given.

However the employer and those in their employ who choose to perpetrate the above - givens - are able to circumvent those employment laws to which the employer is obligated by law to comply with. In other words the employer and those workplace cowardly perpetrators in their employ have a - get out / an escape route - which facilitates both the employer and those cowardly workplace perpetrators in their employ, evading, avoiding and escaping from the full, proper and merited consequences of those workplace perpetrator's unlawful workplace conduct which are those cowardly workplace perpetrator's workplace behaviour of choice and workplace conduct of choice within BT workplace and within the CWU.

Q: How is such evasion, avoidance and escapology successfully accomplished by white BT employees / CWU members who are cowardly, bullying, lying perpetrators and accomplished by their workplace friends/mates/colleagues?

A: By the following means and method.

The employer is presented with - rebuttal evidence(s) - from cowardly workplace racists, cowardly workplace bullies, cowardly workplace harassers complained about, accompanied by supporting evidence(s) presented by those perpetrators workplace friends / supporters / backers / sympathisers / empathisers / those persons of similar and/or like minds to the perpetrators. 

The totality of that accumulated rebuttal evidence(s) is in fact and in reality equivalent to the employer being presented with evidence(s) which states; 
Dear Mr (white) Employer and your formal grievance complaint investigating management, in response to the FS1GC raised against me and/or raised against my white workmate(s) I/We am telling you that: The Sun goes around the Earth. That's right, you heard me/us correctly my/our individual and/or joint rebuttal evidence(s) is (the equivalent to presenting to your FS1GC investigating managers) - the Sun goes around the Earth.

To which Mr (white) Employer and its FS1GC investigating management responds: Does it? Oh, fair enough.

I.E. White people protecting white people protecting white people.

(i) White people lie - blatantly and obviously - lie to other white people. 

(ii) White people back-up support and endorse the lies of other white people. 

(iii) White people in positions of decision making authority , in positions of trust, in positions of responsibility are also in the position to choose  to believe presented obvious blatant sad sick desperate lies / invented concocted made-up fabricated stupid lies- told to them by other white people.

(iv) White people lie to black people. 

(v) And in turn and in due course black people choose, consciously and deliberately choose to lie to white people and choose, consciously and deliberately choose to withhold the truth from white people.

Whilst many many many other white people and black people choose turn and look the other way, too cowardly, too afraid, too frightened and in fear, lacking any and all workplace moral courage and moral workplace integrity to confront, to challenge, to stand up too and to speak up against and oppose Mr (white) Employer's management and that employer's white employees perpetrators.

The question is: How am I able to draw such a conclusions and to present such as a matter of fact?

The answer is simple: I can read ! 

I have read the contents of BT Group's managements' - Employment Tribunal bundle. That is to say confidential / in confidence / highly confidential / privileged (workplace) documentation - disclosed to me - as the Claimant within Employment Tribunal proceedings - and that same substantial BT workplace documentation in turn used to resist me as the Claimant - reads the exact equivalent to - white BT employees (shop floor /line management & HR employees) presenting, stating and representing to other white BT employees: The Sun goes around the Earth.

In black and white and as plain as the nose on your face that is in fact and in reality exactly how the contents of that substantial BT Employment Tribunal bundle workplace documentation reads. 

Full and complete knowledge of those substantial quantities of BT management workplace documentation has made me .....

It is in the vital interests of safeguarding, protecting and attempting to both repair the real and affecting damage done to my own psychological and physical health and well-being - and importantly and crucially - in the vital interest of attempting to prevent any inclination I possess to act and/or react in a manner that would be physically detrimental, physically damaging and physically harmful to myself - that I have embarked upon the long, necessary and arduous task of expressing - as accurately and concisely as I am able too, and doing so at length and in detail - my whole and complete - distressing, affecting and disturbing - full and detailed memory and recollection of my BT workplace experience and CWU trade union place experience c. Dec. 1999 to Sept. 2012.

Blog draft (ii)

Responsibility and blame for the fact that workplace racist cowards and workplace bullying cowards succeed and will always succeed in getting away with it i.e. succeed in perpetrating their abhorrent and cowardly workplace & trade union place conduct and behaviours, that responsibility also lies with those shop floor employees and trade union members (both black people & white people) who are fully knowledgeable of, who witness and/or who are also the victims of such workplace bullying, cowardly perpetrators. 

The responsibility and blame which those black & white workplace employees and/or trade union members hold lies fairly and squarely in the fact that when presented with the opportunity to speak up and to stand up in order to expose the unlawful workplace behaviours of workplace racist cowards and workplace bullying cowards, those black & white people(employees/TU members) refuse to do so. Instead of which they lie, they hide, they plead ignorance, they deceive, they turn and look the other way. In fear and cowardice, lacking all dignity and self respect they so act. Why do such black & white employees / TU members so do? 

The answer is fear. 

Those black and white people (employees / TU members) are frightened and they are scared of the white workplace employees complained about and of the many many workplace friends / supporters / backers of the white workplace perpetrators complained about. Frightened and scared for themselves and for the repercussions which may follow for themselves if they stand up, speak up and present the truth in exposing such white workplace perpetrators of workplace racism, workplace bullying & harassment. 

Those black and white people I speak of are in part as responsible and as blameworthy as the cowardly workplace racists, workplace bullies and workplace cowards complained about and brought to the attention of and brought before the employer's management and/or senior trade union officials.

It is my first hand experience - over a period of twelve years employment within BT Group plc & within the membership of the Communication Workers Union -that a great many white people and black people within those organisations 
repeatedly and consistently showed themselves to be despicable shameful cowards, shameful liars and shameful hypocrites in the face of confronting, challenging, exposing and holding to account white people who are known workplace racist cowards, workplace bullies and workplace harassing cowards.

Having lived through the whole sorry saga as the BME employee & trade union member affected, it is my conclusion that the reason and the cause for that demonstrable and consistent cowardice and hypocrisy of those many many many white people (& black people) can be described in one word; Fear.

White people (& black people) in positions of seniority, authority and  
responsibility who are all too frightened and too scared of the repercussions for themselves from white workplaceperpetrators and those perpetrator's workplace
friends/backers/supporters/empathisers/sympathisers to find against the complained about white employee(s) perpetrator(s) and/or member(s).

My conclusion is supported by (a) my empirical experience over twelve years within BT Group's employ and membership of the BT recognised trade union,
(b) and crucially and importantly - supported by the contents of substantial quantities of privileged / in confidence / confidential - BT Group and CWU documentation disclosed to me via Employment Tribunal claim proceedings.
